Albert Einstein, Thomas Edison, and many other intellectuals actually scheduled themselves time to think. The secret is a scheduled quiet time... with no distractions. The SaaS (software as a service) agreement is the key legal document for sites that provide online services. It's the legal agreement that binds the site's customers and provides critical rules and restrictions regarding the use of the online service. The law of online contracting has become fairly well settled. Since 2002, the recipe for creating an enforceable SaaS agreement is relatively straight forward. This is good news for SaaS sites with online agreements such as Membership Agreements, Subscription Agreements, Content License Agreements, and the like. Nevertheless, there are still costly mistakes to avoid. Two recent cases provide important lessons for all SaaS sites.
