We're still seeing evidence that there are a number of Internet start-ups, despite the economy.

Are Non-Clickers Bound By Your SaaS or Ecommerce Agreement?

In my March 10 newsletter, I referenced my article about a kitty cat named Simba that walked across a keyboard and clicked on an online agreement. The article was part in jest, and part serious because it addressed an interesting question -- is it possible to bind a non-clicker (in this case the kitty's owner) if the person did not click to indicate agreement? You may read the article here.

I've reflected a bit on this, and the issue of whether non-clickers may be bound is critical for SaaS and ecommerce websites that are seeking to create binding agreements to regulate the use of their sites and online services. If non-clickers can't be bound, it would be easy for a user to avoid contract restrictions by simply having someone else establish the online account.
