Dear {!firstname}: Welcome to Your WEBSITE LAW ALERT by Chip Cooper and DigiContracts.com
We're still seeing evidence that there are a number of Internet start-ups, despite the economy. Consistent with this observation is Time magazine's recent piece entitled The New Internet Start-Up Boom: Get Rich Slow. Check it out. |

In my March 10 newsletter, I referenced my article about a kitty cat named Simba that walked across a keyboard and clicked on an online agreement. The article was part in jest, and part serious because it addressed an interesting question -- is it possible to bind a non-clicker (in this case the kitty's owner) if the person did not click to indicate agreement? You may read the article here. I've reflected a bit on this, and the issue of whether non-clickers may be bound is critical for SaaS and ecommerce websites that are seeking to create binding agreements to regulate the use of their sites and online services. If non-clickers can't be bound, it would be easy for a user to avoid contract restrictions by simply having someone else establish the online account. I've researched a couple of recent cases, and you may read my article entitled Are Non-Clickers Bound By Your SaaS Agreement. |

One new feature of our MyLegalFirewall website legal compliance service is that we've combined all of the website documents so that they may be drafted in a single session. For a description of our 3 Packages, go to our MyLegalFirewall page. So now you have an option in drafting website compliance documents -- draft them all at once with duplicate questions eliminated (the most efficient way), or draft them one at a time. As always, this update is free to existing subscribers. This my last reminder regarding the May 1 deadline for adopting a Red Flag Identity Theft Policy. For more information, refer to my article entitled SaaS And Ecommerce Sites - Don't Miss the May 1, 2009 "Red Flags" Deadline. Regards,
