When To Use

For use as an email notice form for emailing to each recurring billing customer PRIOR to charging the customer's credit card as part of a Negative Option Recurring Billing Plan.

Negative Option Recurring Billing Plans are regulated by the Restore Online Shoppers Confidence Act (ROSCA) signed into law by President Obama on December 29, 2010.

ROSCA requires you to (i) make certain disclosures to the consumer, (ii) after making these disclosures to obtain the express consent of the consumers to the Negative Option Recurring Billing Plan, and (iii) provide a simple mechanism for consumers to stop the recurring payments.

You should also ensure that you select the option in our Website SaaS-Account-Membership Agreement (Click-Wrapped) that will result in the addition of the paragraph of the disclosures for the ROSCA Negative Option Recurring Billing Plan. In addition, make sure that the consumer is required to click through on the agreement indicating agreement prior to charging his/her account.
