Notebook Computer Bailment Agreement

Parties

• Bailor (the employer that provides the notebook or handheld computer)
• Bailee (the employee or contractor to whom the notebook or handheld computer is provided)

When To Use

For use by employers with employees or contractors to whom the employer provides a notebook or handheld computer with the expectation that the portable hardware will be used off the premises of the employer primarily for business use, but also for limited personal use.

A bailment agreement is not needed for equipment provided for on-premises use; however, when notebook and/or handheld computers or other portable equipment is provided, a bailment agreement should be used to protect the employer.

Both employment agreements -- Employment Agreement (With IP-Confidentiality) and Employment Offer Letter (W/O IP-Confidentiality) -- incorporate bailment clauses as options.
